Terms of Use

These terms govern your use of the Breath Cycle iPhone app provided by Domenico Marco Di Donna.

Wellness use only

Breath Cycle provides guided breathing for relaxation and mindfulness. It is not intended to diagnose, treat, cure, or prevent a medical condition and is not a substitute for professional care. Follow a comfortable pace and stop if you feel dizzy, short of breath, or unwell.

License

Subject to these terms and Apple’s applicable usage rules, you receive a personal, non-exclusive, non-transferable license to use Breath Cycle on supported Apple devices associated with your Apple Account.

Breath Cycle Pro subscriptions

Breath Cycle Pro is offered through auto-renewing annual and monthly subscriptions. Where displayed and available to your Apple Account, the annual plan may include a seven-day free trial. The localized total price, trial eligibility, billing period, and renewal date shown by Apple before purchase are authoritative. Payment is charged to your Apple Account at confirmation of purchase or when an eligible trial ends.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple subscription settings. Apple handles billing, refunds, Family Sharing availability, and payment processing under its terms and policies. Restore Purchases is available in Breath Cycle Settings. Cancelling stops future renewal but does not normally provide a refund for the current period.

What Pro includes

While your subscription is active, Pro unlocks the paid breathing techniques, recommendations based on feedback you choose to save locally, calibration, the Visual Lab, custom breathing patterns, themes, advanced customization, and optional encrypted backup. Backup requires separate consent and is not enabled merely by subscribing. The purchase screen in the app shows the current included features before you subscribe.

Encrypted Pro Backup

If you explicitly enable backup, Breath Cycle encrypts supported app records on your iPhone and stores the ciphertext through Cloudflare R2. Your device remains the primary copy. Apple-signed app and subscription records are used to authenticate requests, and the encryption key may synchronize through iCloud Keychain. Availability depends on Apple and Cloudflare services, a network connection, a valid Pro entitlement for upload and restore, and access to the encryption key.

Turning backup off stops synchronization but does not delete the stored copy. You can delete the cloud copy separately in Settings even after Pro expires. Ending a subscription or uninstalling the app does not automatically delete it. If the encryption key becomes unavailable, the encrypted copy may be unrecoverable. Keep a local or exported copy of records that are important to you.

Free and Pro access

Just Breathe and the identified free features remain available without an account or subscription. Pro features require an active entitlement. If a subscription expires, local history and previously created records are not deleted, export and cloud deletion remain available, encrypted synchronization pauses, and locked Pro interactions may require renewal.

Availability and changes

The app is provided as available. Visual and haptic behavior can differ by device, accessibility settings, thermal state, Low Power Mode, and operating system. The developer may update, change, or discontinue features while honoring active subscription access and applicable consumer rights.

Acceptable use

Do not reverse engineer, redistribute, misuse, or interfere with Breath Cycle except where applicable law expressly permits it.

Intellectual property

Breath Cycle, its interface, visual system, text, graphics, and software are owned by the developer or used with permission. These terms do not transfer ownership of the app or its content to you.

Liability

To the maximum extent permitted by law, the developer is not liable for indirect or consequential losses arising from use of the app. Nothing in these terms excludes rights or remedies that cannot legally be excluded.

Apple terms

These terms supplement the Apple Standard Licensed Application End User License Agreement. Apple is not responsible for maintaining or supporting Breath Cycle. Where these terms conflict with Apple’s applicable terms, Apple’s terms control.

Governing rights

These terms do not limit mandatory consumer rights that apply where you live. Any governing-law or jurisdiction rule applies only to the extent permitted by those mandatory rights.

Changes to these terms

These terms may be updated when the app, subscriptions, or legal requirements change. The effective date above will be revised, and material changes will be communicated where required.
